The AWR or Agency worker regulations became active on 1st Oct
2011. The AWR act span is over 50 pages. If all its clauses are
taken into account, any totally compliant calculation may extend to
over 3 years of hiring. In the simplest case an Agency worker
working any just one day a week for 12 weeks will meet the needs of
the act. They will then enjoy the rights to pay and conditions
equivalent to a substantive full time employee. One of the clauses
mean that between any pair of applicable weeks, the worker may be
absent for up to almost six weeks. This will not break the course
of accumulation. Put another way, twelve weeks can be accumulated
over a period in excess of a year. On top of this, there are
additional times which cause the accrual to be pause or even keep
running without the worker being physically present.
All these clauses are accounted for automatically by the
internal AWR calculator and simply displayed in line during the
booking process.
